South Africa Considers Remote Gambling Bill to Regulate Online Betting

The landscape of online gambling in South Africa could undergo significant changes with the introduction of the Remote Gambling Bill (B-11-2024) by the Democratic Alliance (DA). This bill, which has been in discussion since 2008 under the National Gambling Amendment Act, aims to establish the first set of regulations governing remote gambling activities in the country.

With the potential enactment of the Remote Gambling Bill, online betting may no longer be as unrestricted as before, as various measures would apply to operators, players, and advertisements. The bill introduces a revamped licensing framework, proposed regulations for operators, and safety measures to mitigate gambling risks, signaling a significant shift in the regulatory landscape.


The Democratic Alliance, after two years of crafting the bill, hopes that its implementation will promote the development of a responsible remote gambling industry in South Africa. Concerns have been raised about the lack of regulation, which has potentially facilitated criminal activity and exposed the public to risks associated with unregulated online gambling.


According to statements from the Democratic Alliance, the absence of regulation has resulted in the loss of revenue and jobs to other gambling jurisdictions. The proposed bill aims to address these issues by providing adequate protection for players and the industry through regulatory measures.

"The ANC government has shown, over these 16 years, that it has no intention of protecting players and the industry from criminal elements. We have therefore taken it upon ourself to ensure adequate protection by means of introducing this private member’s bill," said the Democratic Alliance, as reported by iGaming Business.


Under the proposed bill, three types of licenses would be available: one for remote gambling operators, another for manufacturers and suppliers, and a third for employment. The National Gambling Board would have the ultimate authority over these licenses, supported by provincial licensing bodies to address any illicit activities.


"The regulations for users further stipulate that remote gambling be accessible only to individuals aged 18 and above in South Africa," stated the Democratic Alliance. "Players will be prohibited from obtaining credit from operators and should have the option to opt-out using self-exclusion programmes. Additionally, operators are implementing deposit limits to enhance available responsible gambling measures."


Furthermore, the bill addresses the advertising of gambling services, emphasizing the importance of responsible messaging and prohibiting misleading advertisements.


Overall, the introduction of the Remote Gambling Bill represents a significant step towards regulating the online gambling industry in South Africa, with the aim of protecting players, combating criminal activities, and promoting responsible gambling practices.
